LSTD206 Capstone Paper Essay Example | Topics and Well Written Essays - 750 words

LSTD206 Capstone Paper - Essay Example This informs the basis of the establishment of sound client-relations policies, which do not only serve as the basis of informing how a firm relates with its clients, but also as a marketing tool for the firm, since good client experience is a recipe for increased customer base for a firm (Brink & Berndt, 2008). Therefore, this discussion seeks to establish the client-relations policies that a legal firm should establish to enhance its client relationship as well as its marketing, communication, advertising, confidentiality and conflict of interest handling. This discussion is important for a legal firm, since it creates insights into the relevant strategies that such firms should apply to enhance a productive relationship with the clients, and thus be able to maintain a secured client base, in the face of the ever increasing competition. Discussion Client reception is the core of productive client-relations policies formulation, considering that it is the reception that clients get when they first visit a firm that determines their first impression of the firm, and the consequent future interactions with the firm (Silk, 2012). This being the case, it is therefore significant to ensure that the receptionists and the customer relationship officers within a firm follows certain guidelines that enhances a positive and productive relationship with the client, which enable the firm to project a positive image to the clients, and thus attract them for further visits and interactions. Thus, courtesy and helpfulness is the basis of the customer relationship policy, where the receptionists and the customer relationship officers address the clients with respect and integrity, while offering the essential help that a client could require (Knackstedt, 2008). While being courteous, respectful and helpful serves to enable the client feel comfortable within the firm and feel valued and appreciated as a stakeholder to the firm, it plays the vital role of enticing the customer to make repeat visits. Thus, courteousness, helpfulness and respectfulness serves both as a client recognition and appreciation strategies, as well as firm marketing strategies that encourages further business. Confidentiality is paramount in the legal relationship business, considering that the relationship between a client and a legal firm entails the discussion of sensitive personal, business or family matters, which should not be introduced to the public domain (Nollkamper, 2008). Thus, a confidentiality policy is vital within a legal firm, to ensure that the relationship between a client and the firm, and the issues discussed between them remains between the two parties, and can only be disclosed whenever it is necessary, may be in a court of law. Through implementing the confidentiality policy, a firm is able to ensure that the customer feels comfortable while dealing with the firm, through the knowledge that the personal and confidential information shared with the firm will remain as such, without any risk of unnecessary exposure (Silk, 2012). Client communications and legal advice is yet another aspect that requires that a policy guideline is established to safeguard the relationship. The policy applicable under this concept

Advertising in Deisgn Essay Example | Topics and Well Written Essays - 750 words

Advertising in Deisgn - Essay Example At the very basic level of effective advertising stands the ability to engage the consumer and capture their interest. In this way, design is one of the fundamentals of how this interest can be engaged and how a â€Å"first impression† of the firm/entity/organization/business in question can be represented (Croft, 2014). As such, firms must realize that the design process is a stage that corners should not be cut and costs should not be saved. The underlying reason for this has to do with the fact that effective design of any advertising piece is ultimately the initial representation and branding for the business or organization in question (Muryjas & Muryjas, 2013). As such, presenting a below quality design will effectively destroy the level of engagement that such a piece of advertising could have otherwise hoped to have achieved within any specific market. Unfortunately, many of the art design studios that are responsible for creating the basic renderings for how advertisi ng will take place are oftentimes somewhat divorced from the process itself. What this creates is a situation in which the nuances of what is being created are oftentimes lost on the designers (Lin & Chin, 2013. For this very reason, more and more advertisers have begun to integrate art design specialists within the very first iterations of advertising/market planning. In such a way, the message of what his being represented can more effectively and clearly be displayed through the designs that are utilized to help sell a given good or service (Matisoff et al., 2014). The congruity of the design is also an element that is oftentimes overlooked (Kwong et al., 2011). Even if the design stage and result is something that is visually appealing, the level to which the design resonates with what is being sold or what is being advertised is the true measurement of success. Instances abound in corporate history in which large multinational firms engaged in extraordinarily expensive

The Advantages of Taking Online Classes Compared to Being in a Classroom Essay Example for Free

The Advantages of Taking Online Classes Compared to Being in a Classroom Essay 1. Online Schooling a. Can work at your own pace from home b. Don’t have as many books to deal with c. Will not interfere with work schedule d. Can still travel throughout the year e. Can still communicate with your teacher at anytime f. Don’t have to worry about being late for school 2. Being in a classroom a. Will spend anywhere from two to eight hours in a day in school b. Have to lug big heavy books around from building to building c. You have to juggle your time around school when it comes to work d. Have designated holidays and time off  e. The teacher student ratio can be overwhelming f. Will have to drive to school, find a parking spot and get to class on time While I was trying to decide on my options of going back to school, I weighed the pros and cons of taking classes online versus being in a classroom with my health problems. Depending on what you are going to school for, taking online classes is more beneficial than going to a college classroom. You can get your assignments and work from the comforts of your own home, without worrying about the weather. Whatever books you require for your classes are at home with you to pick up, as you will. You can continue with your full time job and do your online work once you are off from work. You do not have to alter your family life to attend classes because you can do your work from anywhere you can access to a computer. Your teachers are always available to you to discuss your work and you can always reach them either by email or by phone. You do not have to worry about rushing, getting the kids off to the babysitter, or rushing from school to work. When you are in a classroom, again, depending on what you are going for, you can spend as little or as much as two to eight hours a day in a classroom. If you are attending a University, you will have to go from one side of the campus to the other to get to your classes carrying those big heavy books. I have seen many people in the work force having to cut back on their hours at work because they have to put in more time at school, or they have a ton of work to do and they cannot keep up with the flow. Your vacation time is limited to certain times of the year, so if something comes up, you have a lot of protocol to go through to get that time off. I often visited the college campus where my mom worked and I would sometimes sit in on some of the classes as an observer and there would be as many as fifty students in a classroom. Most of the times your teachers are available to you, but once they go home if they do not respond to your email, they will tell you about it in class. If your school is near or far from where you live, it can take as little as twenty minutes to as much as an hour to get to school and back, which in turn can leave you with hardly any time to yourself. Finally, taking an online class gives you the benefit of not having to leave your home to attend a class room. I personally am seeing a tremendous improvement in my household, now that I am home more and I can be here for my kids without trying to work, go to school and maintain my household. On the other hand to some people, being in a classroom can give a better hands on experience in their field of study.

Discussion Between Shareholder Value Perspective And Stakeholder Perspective Economics Essay

Discussion Between Shareholder Value Perspective And Stakeholder Perspective Economics Essay Firstly, it is necessary to understand some definitions of shareholder , stakeholder and the theory of shareholder and of stakeholder . Why there has been many debates between two theories ? Shareholder is an individual or corporation owning stock in a public or private company. Shareholder decides the membership of the board of directors by making a vote . ( Mc Graw Hill , 2003). Maximising shareholder wealth means maximising the flow of dividends to shareholders through time there is a long-term perspective . ( Glen Arnold, 2008 ). Stakeholder are groups and individuals who get benefit from or are harmed by, or whose rights are contravened or regarded by, corporate actions . The list of stakeholder commonly includes customers, employees, suppliers and the community like shareholders and other investors. As stated by Frederick R.Post , shareholder theory supports that management is allowed to ignore the interest of the the other constituencies while pursuing the interest of the shareholder owners. Moreover, in the perspective of finance, shareholder wealth maximisation is accepted as being obvious logically ( Anant K. Sundaram , Andrew C. Inkpen, 2004) . The stakeholder theory has initial root in the research involving business , society and ethics. The first argument is supported to this theory by Freeman (1984). The stakeholder theory says that managers should pay attention to all stakeholders in a company , including not only financial claimants, customers, communities, governmental officials but also under the environment, terrorists or even blackmailers ( Michael C. Jensen , 2001). According to Thomas L. Carson, corporation should be operated for all stakeholders, not just for the shareholders. However, here are some misled understanding of shareholder theory and stakeholder theory needed to be explained . Sometimes people think that manager can do everything as long as getting profit regardless of ethical issue. But the shareholder theory forces manager to raise profit only through legal, nondeceptive means ( Friedman, 1962 ) . Moreover, it is sometimes said that shareholder theory is not willing to give corporate funds to charitable projects or training employees, but in reality when employees are trained , their skills are improved and maybe the effective work is better then ever before. Also the stakeholder theory is misunderstood that it does not require a firm to focus on profitability. Although the primary objective of the stakeholder theory is the concern of involving parties, it must be attained by balancing the interest of all stakeholders including all shareholders. In my opinion, shareholder wealth maximisation should be a superior objective over stakeholder interest . Some academic argue that there is a factual and normative consensus that corporate managers should act exclusively in the economic interests of shareholders and that the best means to this end the pursuit of aggregate social welfare is to make corporate managers strongly accountable to shareholder interest ( Hansmann and Kraakman,2000, pp 1 and 9). The logic in factual consensus shows that economic compels managers to maximise shareholder wealth by mass series of different propositions like that firms can be operated effectively thanks to perfect competitive markets for goods and services . After that the pursuit of economic efficiency creates firm-wealth maximisation and the firm wealth maximisation matches shareholder wealth maximisation ( Sundaram and Inkpen, 2004 ). Then competitive market also puts pressure on managers to maximise shareholder wealth. The logic for standa rd consensus illustrates that economic efficiency maximises social welfare. However, the market is not perfect , there are many conflicts of interest that shareholders can benefit by taking from other stakeholders. For instance, they can renegotiate contracts under changed conditions or adopt an investment policy that redistribute wealth from other stakeholders. Doing favour to shareholder is dependent on their situations., firms shareholders are closer to financial default which does not care much their reputation . With the assumption is that perfect competitive market, any firms always want to increase share prices benefits shareholders . It is carried out by selling, buying or holding their shares. But if we skip these assumptions, unanimity can leave. Foe example, if managers know something that investors do not know and realise that the intrinsic value in the stock is higher than its market value. Therefore, what shareholder wealth maximisation is unclear. It depends whether s hareholders want to keep or sell their shares. If shareholders want to sell, managers could involve in various costly signaling actions to correct the potential mis-pricing. Adversely, if shareholders do not want to sell, signaling activities are less logical. We also raises questions about the experiences foundations that managers are not even willing pay lip services that they want to maximise shareholder wealth. Because for whatever reason, managers are not ready to publicly approve shareholder wealth maximisation with much enthusiasm. In contrast, they prefer to seeking several targets and shareholder wealth is often not one of them. Furthermore, they are reluctant to show ranking for the various targets they pursue, and even if they do, there is still less evidence that shareholder wealth maximisation plays the top priority . The stakeholder theory also has drawback like that how to realise corporate social responsibility , for example how to consider all stakeholders interests appropriately which is often flawed in that they do not take into account the various essential conditions and institutional restrictions of corporate decision making as to the problems of behaviour by the people who influence corporate decisions. Moreover, corporate governance is involved in how business company should be controlled legally. Management has a fiduciary task to serve the interest of shareholder and shareholder wealth maximisation should be objective of the company prescribe how strategy and investment decisions can be made. They show us little about how managers actually do their duty of managing a company to create value for shareholder . There are some ways that stakeholders can be treated unfairly, and each unequal treatment might rise efficiency at the expense of another. Thus, economic system is required to ens ure the basis fairness and managers have responsibility to behave toward all stakeholders with fairness and moral concern. A situation can be caused for stakeholder management, then if these legal obligations are insufficient to make sure the equal treatment of all stakeholders. Just corporations should defend and assist the interest of all stakeholders, they should behave all stakeholders fairly. From the above definitions, we can see that shareholder is one of the dimensions of stakeholder. But if we thinks that considering stakeholder interest as superior over shareholder wealth , it also means we must pay attention to all objectives of stakeholder interest . It is difficult to practice this because various stakeholders has conflicting or different objectives . Shareholder wealth maximisation is a single-value objective focusing on the owners of a company. Shareholder wealth maximisation supplies guide of workable decision as well as support the total value creation of the firm if pursued. In turn, it promote each group reach a greater share. Employees who finding expanded benefits are more likely to obtain these goods if the firm is prospering. And the same argument can be developed with suppliers, customers or investors and other stakeholder group It does not mean that stakeholder is disregarded comparing the owners. Reversely, the interest of other constituencies is need ed being aware but the owner is considered first. Because the objective of a firm is to maximise shareholder wealth in the long run , and the shareholders is real owners of a firm. They establish a company to get profit . But to get profit , they must have management strategy for community, employees and customers. Therefore whether they operate their company in which way , the final objective is always to maximise shareholder wealth. The problem is that should we view shareholder wealth maximisation as higher-ranking objective than stakeholder interest or just taking into consideration shareholder value maximisation ignoring the interest of other constituencies ? The answer is that shareholder wealth maximisation should be a superior over stakeholders interest combining the taking account of other constituencies. Furthermore, to get shareholder wealth maximisation in the long run, a company must care customers, environment. It is obvious that in reality, a company want to survive a nd operate successfully , it should have many strategies to pay attention to customers such as after-sale services, promotion. Enron case is a remarkable example to show the failure of shareholder theory in pursuing shareholder wealth maximisation not paying attention to stakeholders interests. 2001 was the year with the largest bankruptcy reorganisation in American history, it made stock price fallen and Enron is a superlative illustration of largest financial fraud. Enrons stockholders and employees are the most visible victims, and 4000 employees were quitted around the bankruptcy time . Besides, the failure of Enron was because of that the pursuit of intermedia shareholder wealth made it involved risk prone and caused to misapply economics . It requires too much from strategies with regard to the increase in earnings per share. Academic explains shareholder wealth in the mention of management practices that increase productivity. In recent year for fair investors, the practice of shareholder wealth maximisation does not mean patient investment. As an alternative it gets obsessed with short term showing n umbers. In Vietnam, Vedan case is also extraordinary example in the showing the failure of not paying the environment. It is a Taiwanese company specialising in producing monosodium glutamate in Vietnam. Vedan Vietnam was discovered discharging thousands of cubic meters of untreated toxic wastewater directly into the Thi Vai River for nearly fourteen years . It polluted seriously the river basin resulting in economic damage, negative effects on life and health of farmers in the region. As the result, Vedan company must pay 120 millions offered by the damaged provinces. And vedan company agree to pay condensation from now to 2011. And there is worthy-sad truth is that Vedan has been being boycotted gradually in Vietnam. These are two examples making clear that the failure of pursuit shareholder wealth maximisation not caring community. Besides, there are still lot of companies running successfully for a very long time because they know well how to maximise shareholder wealth accompanying care of other constituencies . In conclusion, shareholder wealth maximisation should be a superior objective over stakeholder interest. However, to get maximise shareholder wealth in the long run, a firm must pay attention to stakeholder interest . Therefore, a firm want to operate successfully, besides maximising shareholder wealth, it should satisfy the interest of stakeholders.

The Pros and Cons of Abortion Essay -- Abortion Essays

The topic of abortion is one of the most controversial issues in today’s society. Thousands of abortions take place every single day, and yet public opinion remains at a standstill as to whether or not abortion is ethical or not. According to a poll in 2013, fifty-four percent of the American public believes that the practice of abortion should be legal in all or most cases (â€Å"Public Opinion on Abortion†) Abortion has been defined as â€Å"the act of removing a human embryo or fetus from the uterus of a pregnant woman prior to the completion of the full term of pregnancy†(Rich, Wagner, and Geraldine). There are very strong opinions for and against this issue, but no one can deny the vast gray area of abortion. A person’s stance on the situation is often determined by how he views the fetus: a part of the mother’s body or as a human being. Abortion continues to be a moral issue because people have various views on the rights of the fetus and mo ther, the circumstances of the pregnancy, and their own religious convictions concerning the issue. In the most recent study, 1.21 million abortions took place in the United States in the year 2008 (â€Å"About Abortion†). According to a study performed by the Guttmacher Institue, twenty-one percent of all pregnancies in the United States end in abortions (â€Å"Induced Abortion†). Fifty percent of pregnancies in the United States are unplanned (â€Å"Induced Abortion†). Of those unplanned pregnancies, four out of ten result in abortions (â€Å"Induced Abortion†). When analyzing the statistics of women who receive abortions, one must become aware that outside circumstances might contribute to a woman’s decision to have an abortion. For instance, women who are one hundred percent below the federal poverty level ac... ...rtion Federation: History of Abortion. National Abortion Federation, n.d. Web. 17 Mar. 2014. A Women Of Castigliones The Courtier And Machiavellis The Prince :: essays research papers

Essay on Woman Leader Machiavelli and Castiglione both present the epitome of perfection in their topics of leadership and the way a women should be, respectively. In the case of Castiglione's work, it is stated by signor Gaspare that "...in the way people sometimes hanker after things that are impossible and miraculous, rather then explain them you (Magnifico) have wished them into existence." This quote is true of both excerpts. Both have created idealisms that are of perfection; however, both do also allow for imperfection. Again in the excerpt from Castiglione's work where Magnifico states "...because man is more robust, more quickly agile and more able to endure toil..." shows the obvious imperfections of the female gender. Machiavelli, on the topic of leadership, also talks of imperfections: "The new prince - above all other princes - cannot escape being called cruel, since new governments about in dangers." Leaders therefore are left to the mercy of their own imperfect ions and the imperfections of the human spirit. Perfection, even mixed in with a few imperfections, is very hard to meet. One would have to be of the offspring of God to meet some of the qualities mentioned. However, far from the offspring of God, there is another that comes close to many of the generalizations stated. She is a leader behind a leader and is probably one of the strongest women of her time. First, Mrs. Clinton as a leader possesses many of the qualities mentioned by Machiavelli; such as her toughness and appearance of good morals. In Castiglione's realm, she matches the qualities of dignity and strong virtues. Hillary Clinton clearly shows qualities mentioned in both excerpts regarding her position as a leader and as a woman. First, Hillary Clinton as a leader possesses a great number of qualities mentioned by Machiavelli, one of which is represented in her handling of the Whitewater scandal. Machiavelli gives and example of how it is important to, "in order to keep his position, act contrary to the truth." Mrs. Clinton most likely lied about her involvement in the scandal in order to "keep her position" as a leader. Mrs. Clinton also fits true to what Machiavelli says about appearance: "...it is not necessary actually to have all the above-mentioned qualities, but it is very necessary to appear to have them"; the qualities being: merciful, trustworthy, humane, blameless, and religious. The first lady appears to be trustworthy, in that she holds true to her contract of marriage although her husband has made and abomination of the sacred agreement.

Should Public Schools Require Student Uniform?

A school uniform is a specific design for clothing designated to be worn while attending academic classes at a school. The school context comprises grades one through twelve of public and private schools in the United States. Different schools and different grades within schools may have different uniforms, as determined by parents and school administration. In today’s society all public schools should require student uniform. These generations of school kids are more worried about how your hair looks, what name brand clothes you have on, and also what kind of shoes are on your feet. These kids are worried about all the wrong things. Instead of worrying about their peer’s attire they should be into their books. Worrying about all the wrong things can be distracting. When ones focus is on something other than what’s important can cause sidetracking. â€Å"We are under no illusions that it's a silver bullet that is going to make kids smarter,† school board Pr esident Pedro A. Ramos said last week. â€Å"We do think it will improve school climate. It removes a lot of anxiety and stress from lives of our students and parents,† (Johnston). To understand why this is an issue, let us look at the problem, why the problem is significant, whom the problem affects, why others’ attempts have failed, and how I propose to solve the problem. This is an everlasting debate that whether school uniforms should be worn or casual clothing is as good. And like most of the popular debate in the world it has no concrete answer, it totally depends on a person’s beliefs actually. For some it is a benefit for others a disadvantage. I believe public schools should require students to wear uniforms.First wearing school uniforms promotes good discipline. Second it reduces distractions. Thirdly it is a far less expensive to buy school uniforms than many other clothes. The problem is that public schools should require student uniform. Having all s tudents wear uniform causes the students to focus more on school and not each other. In today’s generation, requiring uniforms would take a lot of the pettiness and bullying over fashions and brands out of the schools. Today in most schools kids spend most of their time judging others by their attire rather than personality.Worrying about other things such as what everyone else is wearing takes attention off of learning and turns it onto attire. Is students paid less attention on what others were wearing and focus on school they would do much better in school. Most times when kids look down on other kids about their clothing it is a sign of bullying. Bullying starts when one person messes with another because they think they’re superior to the other person. It can also start by cliques forming and one clique talking about another clique’s apparel. Gang-related issues are pretty prevalent as a reason for using dress codes,† which often prohibit caps, earrin gs for boys, beepers, baggy clothes, and other gang-linked paraphernalia, says Jay Butler of the NSBA. School districts generally have found the codes â€Å"effective,† though not a cure-all, he said (Tyson). Students are affected by the schools wanting them to wear uniform. They are affected because what students wear is a sign of their own identity and individuality. Allowing students to wear what they want allows them to express how they feel not only through their character but the way they dress. Many students feel as though taking away the ability for them to wear what they want will not stop violence, failed grades, and also bullying. Most teachers and parents believe that when students wear uniform they don’t have to worry about appropriate versus inappropriate clothing. Also, fighting in the morning about what they can and can’t wear to school. According to at Brunsma at â€Å"The Journal of Education Research† and Rockquemore of University of Not re Dame, such creative hindrance encourages a power dynamic among students and faculty: If students feel inferior to faculty, they may also feel unsupported. This dynamic can impede their ability to focus in school, which can lead to behavioral issues (Foster). But in most schools that don't require uniforms, it is common for a teen or preteen student to feel pressure to wear trendy clothing lest she/he be viewed as economically disadvantaged or different. This is a big controversy between students and adults also between adults and adults. Having school uniforms in public schools is very important. Many people may ignore the signs that school uniform is a big issue in today’s schools, but others understand the need for these uniforms. One big problem is that when you give kids the ability to wear what they want that gives them a chance for freedom of expression. School uniforms stifle self -expression, and the development of the self is as integral as the development of the mi nd. Experts believe that there is no stopping self -expression in the psychological development of children and teenagers, and that more inappropriate means of expression will arise if clothing is restricted (Directory of Schools). To eliminate the use of derogatory clothing between young public school kids uniform should be rewarded.Having uniform will lower the parents having to fight with the child every morning with what they can and cannot wear to school. People that have attempted to try to get public schools to enforce school uniforms have failed in many different ways. They have failed because many people believe that just giving children uniforms will not stop them from bullying. Children bully others on the way they look such as the way other’s hair look, what type of sneakers they have on, and their classification. If school codes are already hard to enforce why they should put another problem on the staff’s hands. Sharp decreases in school crime reported by some districts that switched to uniforms have encouraged others to â€Å"follow suit. † In one prominent example, after Long Beach, Calif. , became the nation's first district to require uniforms at elementary and middle schools in 1994, crime dropped 36 percent among the 60,000 students (Tyson). Many people have so many different beliefs when it comes to school uniform.I propose to solve this problem by obtaining a survey. I will have two different surveys. I will survey 100 public school children and 100 parents. I will ask everyone the same question. I will ask public school students do they believe uniforms are the best thing for the students. Why? Before I give the survey I will collect information online about why public schools should enforce the use of uniforms. I will then give them the information I found about or why public schools take on the effort to have student uniforms. After that I would tell them my position on the public school uniforms conflict and that I like the idea. Finally, when all the data is collected from the survey I will tally the votes up and give them to the School Board of Education. In conclusion, because of the bullying that goes on with non-school uniforms, public schools should have school uniforms. Public school uniforms are very important and critical because there will not be a differentiation between rich or poor. Like for girls whose shirts are cut lower, or if a boy wears those checkered shorts that they seem to love so much. But with uniforms all of that is taken away because everyone will be wearing the same thing. I know your first questions will be: â€Å"But where's the individuality? † But it can still be there. Kids who roll their sleeves up or fold their collars differently, or who tuck their shirts in or leave them out. There are a LOT of factors to keep in mind. So just to talk about a child individuality and to not protect the other kids that can get emotionally, mentally, and physically damag ed by just one word because of what regular clothes they have on is unacceptable.
